Landlord and Tenant

Located in Toms River, Ocean County, New Jersey
Eviction Notice

Whether you’re a landlord or tenant, you have fights under New Jersey law.  In any landlord-tenant dispute, we recommend both parties have an attorney in place.

Do you want the best possible outcome in the litigation of landlord-tenant disputes?

Carluccio, Leone, Dimon, Doyle & Sacks offers significant experience in New Jersey landlord-tenant court.  Whether you’re trying to evict a renter, trying to fight an eviction, or simply navigating a complex leasing process, we’re here.  For both landlords and tenants, the first step is the same: Know your rights.

Tenant Rights in New Jersey

Facing a dispute with your landlord can be intimidating. Eviction, legal expenses, security deposits… it can seem like they hold all the cards. But landlords in New Jersey must follow strict rules, and as a tenant, you have rights.

What are your landlord’s obligations to you? When do you have a right to withhold payment? What resources and options are available for you to resolve a dispute?

New Jersey renter’s rights are well-established. For example, did you know that security deposits are not permitted to exceed one-and-a-half month’s rent? Yes, even if you have a pet. What’s more, any interest earned on your security deposit belongs to you. Your landlord must pay it to you in cash, or credit it towards your rent. They must also notify you of the account number and location of the deposit amount.

As a tenant, you also have a right to habitability. Your landlord must provide vital repairs and maintenance. This can include plumbing, air conditioning, and even small repairs, such as locks.

There are also procedures your landlord must follow when attempting to evict you. Even once an eviction complaint has reached the court, you still have options available. If you’re facing eviction, you need information, resources, and representation.

We’re here for you. We’ll fight for your rights in:

  • Habitability hearings
  • Security deposit litigation
  • Wrongful eviction
  • Unlawful disposition of property actions
  • Disorderly Conduct
  • Other matters commenced by tenants.

Landlord Rights in New Jersey

Individual owners. Small and large residential and commercial building and complexes. Management companies. Realtors. Condominium associations and not-for-profit organizations. What’s one thing they all have in common? Sometimes, there are issues with tenants that call for eviction.

At Carluccio, Leone, Dimon, Doyle, and Sacks, we understand how important it is to protect your investment. That’s why our team of lawyers for landlord-tenant disputes are here to help. We stand ready to provide the immediate attention all evictions need.

The slightest delay in processing your eviction case can mean lost revenue for you. Due to our proximity to the Ocean County Courthouse, we can ensure same-day filings. But evicting a tenant is not that as simple as filing a complaint.

New Jersey’s anti-eviction statute, N.J.S.A.2A:18-611, provides that a residential tenant may only be evicted for a cause. Causes for eviction can include:

  • Nonpayment of rent
  • Violation of lease rules and covenants
  • Habitual late payment of rent
  • Owner occupancy and certain enumerated criminal offenses

However, most reasons for termination require a specific set of notices. You’ll need to serve these notices before commencing an action in the landlord-tenant court. An eviction lawyer can help guide you through this process.

Carluccio, Leone, Dimon, Doyle and Sacks will serve all necessary notices. Our attorneys for landlord-tenant issues will represent your interests in landlord-tenant court. If necessary, we will arrange with the court constable for lockout of tenants following the eviction grant.

We represent landlords as they deal with:

  • Unpaid rent
  • Property damage
  • Eviction actions
  • Other breaches of lease issues with their tenants
